Meanwhile, back at the court
Dave Budge has good stuff on the Supreme Court decision this morning on eminent domain. I haven't had time to look at the opinion, but my instincts are on the side of the dissenters. Still, I think this is a close call, and a 5-4 decision is perhaps no surprise. While I don't think the government has any business taking property from one citizen so that another can profit, figuring this out when the public good is involved might be trickier than it appears.

Of COURSE this decision is horrendous! But the really, really, REALLY interesting thing is that the rightwing is saying that this decision is a result of a, now get this, LIBERAL COURT! So, what is the proper reaction to this outrageous decision? Appoint even GOOFIER, MORE FASCIST judges! Kafka couldn't even dream up THIS stuff! Watch ol' Fudge. He'll get around to this too. The way to correct a problem is throw more corporate fascism at it!

Matt, if some bastard city councilman or country commissioner decides that MY land could be better used for economic development by putting some rich bastard's hotel on it, I would NOT be responsible for my actions! But I'll tell ya this, I would simply ask for a jury trial after the dust settled and the rich bastard recovered! For you see, this is still the west, and landowners get downright testy when someone screws with their land! I don't think this decision will stand. Like I said, just try to find a jury sympathetic to some rich bastard that was burned out!

This decision is the triumph of the artificial corporate entity over the individual. The court has ruled that an artificial person's interests supercede the interests of living breathing individuals. The ruling also signifies the merger of corporate America and the American government into a single entity.

Jim, take out your dictionary and look up the definition of fascism. I think that you've nearly defined it perfectly! ie. A philosophy or system of government that advocates or exercises a dictatorship of the extrene right, typically through the merging of the state and business leadership, together with an ideology of belligerent nationalism! The main emphasis of the ruling is to limit the federal government's role in this action and leave it up to the states and the communities involved. For some people, that seems best but I agree with Larson. The ruling sucks and given the fact that local governments are much more susceptible to the big companies, it means a real blow to private property.
